The City of Armadale (the City), as a permit authority, is obligated to ensure buildings are constructed and occupied in accordance with the relevant permit or certificate.
The City's Building Compliance Officers may enter a property to inspect building work or investigate reported compliance issues.
In cases of non-compliance, a Building Notice or Building Order may be issued. Where possible, the City will liaise with a property owner to achieve a solution and assist with obtaining compliance. Failure to comply with a Building Order
Compliance issues relating to the Building Act 2011 include, but are not limited to, the following areas:
Non-compliance with an approved building or occupancy permit
Building work affecting a neighbouring property
Unauthorised building work
Dangerous, dilapidated or neglected buildings and structures
Uncontained builder's rubbish
If you wish to report a possible building compliance issue, please complete a Building Compliance Request form.
Anonymous requests will only be investigated in exceptional circumstances.

Alternatively, you can submit your completed Building Compliance Request form in person at the City's Administration office located at 7 Orchard Avenue Armadale or via Australia Post.

If you need to apply for retrospective approval for building work, you will first need to contact a registered private Building Surveyor about obtaining a Certificate of Building Compliance (BA18). The Building Surveyor will advise you what documentation you will need to collate.
Once a Certificate of Building Compliance has been issued, you can submit an application for retrospective approval with the City of Armadale (the City).

There may be additional factors to consider, such as planning requirements and easements, which could impact your application.
You may need other retrospective approvals before applying for Building Approval Certificate or Occupancy Permit.

The building classification of the structure you need approved determines the type of application you will need to submit.
Residential Class 1 and 10 structures - Building Approval Certificate application.
Commercial Class 2 to 9 structures - Occupancy Permit application.

A building approval certificate can be used to obtain approval for:
Unauthorised building work or
A building that was constructed in accordance with the relevant standards applicable at the time of construction, and on its completion could be occupied or used without an occupancy permit, certificate of classification or any other authority under written law.

Complete a BA13 - Application for Building Approval Certificate form.

A Construction Training Fund (CTF) levy is applicable to unauthorised building work valued at $20,000 or more.
The CTF levy is payable direct to the Construction Training Fund via their online payment portal.

Payment must be made when your application is lodged.
A Building Services officer will contact you for credit card details via phone for fee payment.

An occupancy permit is required for Class 2 - 9 commercial buildings in the following circumstances, as per the Building Act 2011:
Occupying a newly completed building,
Occupying a partially incomplete building or building on a temporary basis,
Modifying a current occupancy permit for additional use of building on a temporary basis,
Occupying a building that requires a permanent change of use in any way,
Obtaining approval for unauthorised building work,
Replacing an existing occupancy permit or certificate of classification.
